Uganda Judiciary Clarifies Misconceptions Surrounding Constitutional Court’s Decision on Narcotic Drugs and Psychotropic Substances (Control) Act, 2015

Responding to recent speculations surrounding the repeal of the Narcotic Drugs and Psychotropic Substances (Control) Act, 2015 by the Constitutional Court, the Judiciary has released a statement aimed at dispelling any misunderstandings. Contrary to circulating media claims, the Judiciary firmly asserts that the court’s decision does not entail the legalization of marijuana or any other restricted substances.

In their statement issued on Tuesday, the Judiciary explicitly clarified, “It is important to understand that the Constitutional Court never legalized the use of restricted drugs or substances under the impugned law.” The court’s decision was never intended to legalize the use of such substances.

To address the legislative void resulting from the repealed act, the Judiciary emphasized that the National Drug Policy and Authority Act, the previous law superseded by the Narcotic Drugs and Psychotropic Substances (Control) Act, 2015, remains in full force.

The Judiciary stated, “The annulment of the Act does not nullify the provisions outlined in sections 26, 29, 47, 49, and 60 (1) (b) and (c) of the National Drug Policy and Authority Act, which now serve as the applicable law regulating and controlling restricted substances. Consequently, substances that were previously restricted under the National Drug Policy and Authority Act remain restricted.”

Law enforcement authorities have also clarified their position on the matter. In a statement on Monday, the police announced their continued commitment to enforcing the National Drug Policy and Authority Act, despite the annulment of the Narcotic Drugs and Psychotropic Substances (Control) Act, 2015. This decision underscores the significance of upholding existing regulations and ensuring responsible usage of controlled substances.

Given the importance of providing accurate information to the public and dispelling any misconceptions, it is crucial to have a clear understanding of the recent court decision. The Judiciary, in collaboration with law enforcement agencies, remains dedicated to upholding the rule of law and prioritizing the well-being of the community.
